Debtor Examination Ontario — Discover Assets for Judgment Enforcement
A debtor examination (also called an examination in aid of execution) is a court-ordered process that compels a judgment debtor to attend and answer questions under oath about their assets, income, and financial affairs. Our licensed paralegals use this tool to gather the information needed for effective judgment enforcement.
What a Debtor Examination Covers
At a debtor examination, the debtor must answer questions about their employment and income, bank accounts and financial institutions, real property and other assets, vehicles, investments, and any other assets that could be seized to satisfy the judgment.
When to Use a Debtor Examination
Debtor examinations are particularly useful when you do not know the debtor's employer, bank, or assets. The information obtained can then be used to issue wage garnishments, bank garnishments, or writs of seizure and sale.
