What Qualifies as Compensable Damage
Under the Residential Tenancies Act, a landlord may apply to the LTB for compensation if a tenant, an occupant, or a guest has wilfully or negligently damaged the rental unit or property. This includes damage beyond ordinary wear and tear.
The L2 Application Process
Before filing an L2 Application for property damage, a landlord must first serve an N5 Notice. The N5 gives the tenant 7 days to pay for or repair the damage. If the tenant does not remedy the situation, the landlord may file an L2 Application at the LTB.
