T2 Application — Tenant Rights Violations
A T2 Application is filed when a landlord substantially interferes with a tenant's reasonable enjoyment of the unit, harasses the tenant, or enters the unit illegally. The LTB can order the landlord to stop the conduct and award compensation including rent abatement.
Illegal Entry
Under the Residential Tenancies Act, a landlord must give 24 hours written notice before entering a rental unit, except in emergency situations. Repeated illegal entry without notice is grounds for a T2 application.
Harassment and Intimidation
Landlord harassment includes threatening behaviour, withholding services, interfering with utilities, repeated unwanted contact, and attempting to coerce tenants into leaving. These actions violate section 23 of the RTA and may support T2 and T3 applications.
